Terms of Use

1. The agreement

Bloomkind (“the app”) is made by OB Data LLC (“we”, “us”). By downloading or using the app you agree to these Terms of Use and to Apple’s Standard End User License Agreement, which governs your licence to the software. Where the two overlap, Apple’s Standard EULA controls the licence itself; the terms below add the details specific to Bloomkind and to Bloomkind Pro.

If you do not agree, please delete the app.

2. Your licence

We grant you a personal, non-transferable licence to use Bloomkind on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, decompile, reverse-engineer, resell or redistribute the app, or remove any notice in it, except where that restriction is prohibited by law.

3. Bloomkind Pro — subscription terms

The daily diary, one-tap logging and basic statistics are free. Bloomkind Pro is an auto-renewable subscription that unlocks the doctor-ready PDF report, every correlation and pattern view, unlimited history and HRT/supplement analytics.

• Price and length. $5.99 per month, or $39.99 per year. Prices are in US dollars; in other regions the App Store shows the local equivalent, which is the price that applies to you.
• Free trial. New subscribers get 7 days free. If you cancel before the trial ends you are not charged. Any unused part of a free trial is forfeited when you buy a subscription, where that applies.
• Billing. Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
• Automatic renewal. The subscription renews automatically for the same period at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the end of that period.
• Managing and cancelling. Go to Settings › Apple Account › Subscriptions on your iPhone. Cancelling stops the next renewal; the subscription stays active until the end of the period you have paid for. Deleting the app does not cancel a subscription.
• Refunds. Purchases are handled entirely by Apple, so refunds are requested from Apple at reportaproblem.apple.com. We cannot issue refunds ourselves.
• Price changes. If we ever change the price, Apple will notify you and ask for your consent before the new price is charged, as its rules require.

Buying Pro creates no account with us. Your subscription is verified on your device by Apple’s StoreKit; we never see your name, email or payment details. If you reinstall the app or change device, tap Restore purchases on the Pro screen.

4. What Bloomkind is — and is not

Bloomkind is a symptom-tracking and education tool. It records what you choose to log, optionally reads what you have already logged in Apple Health, and shows it back to you as charts, patterns and a printable report.

It is not a medical device and does not provide medical advice. It does not diagnose any condition, does not recommend or evaluate any treatment, and does not tell you whether a medication or hormone therapy is working. Correlations and trends it displays are descriptive summaries of your own entries — they do not establish cause and effect. Logging HRT or supplements means recording what your clinician has prescribed; it is never a recommendation to start, stop or change anything.

Always talk to a qualified clinician about symptoms, medications and hormone therapy, and never disregard or delay professional medical advice because of something you saw in this app. If you think you may have a medical emergency, call your doctor or your local emergency number.

5. Your data and your responsibilities

Everything you log stays in an encrypted store on your device. We do not receive it, and we cannot recover it — see the Privacy Policy for the full detail. Because there is no cloud copy, keeping a backup is up to you: an encrypted iPhone backup preserves your log, and the app can export everything as JSON or PDF at any time. Erasing your data in the app is final.

You agree to use the app only for your own personal, non-commercial symptom tracking, and to keep anything you export — a report is health information — somewhere you are comfortable with once it leaves the app.

Bloomkind is intended for adults. It is not directed at children under 13, and we knowingly collect nothing from anyone.

6. Availability and changes

We may update the app to add, change or retire features, and we may update these terms. When terms change we will update the effective date at the top of this page, and material changes will be described in the app’s release notes. Continuing to use the app after a change means you accept the updated terms. Your existing subscription price will not change without your consent.

7. Disclaimers and liability

The app is provided “as is”, without warranties of any kind to the fullest extent the law allows, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that charts, correlations or imported Health data will be complete or accurate.

To the fullest extent permitted by law, OB Data LLC is not liable for indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of the app; and our total liability is limited to the amount you paid for the app in the twelve months before the claim. Some jurisdictions do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

8. Apple

Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

9. Termination

You may stop using the app at any time by deleting it — and, if you subscribe, by cancelling as described above. We may suspend or end your licence if you materially breach these terms. Sections 4, 5, 7, 8 and 10 survive the end of this agreement.

10. Governing law

These terms are governed by the laws of the United States and of the state in which OB Data LLC is organized, without regard to its conflict-of-laws rules, and without limiting any consumer-protection rights you have where you live.
